OVERVIEW

The design of this participant manual is to examine pertinent sections of Criminal Code of Canada (C.C.C.)  to understand when a use of force may be warranted, the proportionality of that force, and to teach participants how to articulate, in both a written and verbal format, their actions during a use of force encounter.

This participant manual provides the notes that you will discuss from the PowerPoint Slides that accompany this work. Underline key points for your own later reference and write down questions to ask later, during and after your presentations.

PURPOSE

Identify all the relevant factors at play regarding proper use of force articulation based upon relevant case law and legislation within Canada.

OUTCOMES

  • Articulate how to justify one’s actions regarding involvement in a use of force encounter.
  • Identify relevant sections of the Criminal Code of Canada (C.C.) as it relates to use of force.

The Criminal Code of Canada
The Criminal Code of Canada The Criminal Code of Canada (C.C.C.) is a vast legal document, and Peace Officers and other authorized officers need to have a base understanding of what their legal authorities are under the C.C.C. to be able to lawfully execute their duties to their employer. The main sections of the Criminal Code of Canada that Peace Officers and other officers should be cognisant of (though not be limited too) are: • Section 25 of the C.C.C. - Protection of Persons Administering and Enforcing the Law • Section 26 of the C.C.C. – Excessive Force Section 27 of the C.C.C – Use of Force to Prevent Commission of an Offence • Section 34 of the C.C.C. – Defence of Person • Section 35 of the C.C.C. – Defence of Property • Section 494 of the C.C.C. - Arrest without Warrant and Release from Custody • Section 495 Awareness—application of C.C.C. in application to “other officers—security guards, Community Peace Officers. (See Appendix A)
